Heard Mr. Tapse, the learned advocate for the petitioner and Mr. Bharad, the learned AGP for the respondent nos.1 and 2 and Mr. Dheple, the learned advocate for the respondent nos.3 and 4. 2.

The learned advocate for the petitioner submits that the petitioner is seeking pensionary benefits.

The learned advocate submits that for his failure to produce certificate of validity, that he was not being paid the pensionary benefits. He submits that the petitioner's proposal has been pending with the scrutiny committee and validation of the tribe certificate for Tauseef

He submits that in the light of the government resolution dated 14.12.2022, creating supernumerary post and transfer of the employees to such posts who have faced invalidation. He submits that the petitioner would approach the committee and would not press his proposal.

We dispose of the petition permitting the petitioner to approach the committee and file such affidavit, which the committee may permit to be filed and dispose of his proposal. 5.

We further grant liberty to the petitioner to approach the respondents and claim pensionary benefits in the light of extant policy. 6.

Writ petition is disposed of.
