Heard Mr Y.R. Marlapalle, Advocate for petitioner and Mr Sachin Vaidya, learned Advocate holding for Mr Y.I. Thole, learned Advocate for respondent. 2.

Mr Marlapalle, learned Advocate for petitioner seeks leave to withdraw this petition on account of amicable settlement arrived at between the parties. He points out the terms of settlement, more particularly, Clause 40 of the settlement whereby the petitioner/management has been allowed to withdraw the amount deposited pursuant to the order dated 15.10.2018 passed by this Court along with accrued interest, if any. Mr Sachin Vaidya, learned Advocate holding for Mr Thole, learned Advocate for respondent has no objection to withdraw this petition as well as to withdraw the amount deposited by the management in view of settlement terms arrived at between the parties.

Having regard to the submissions made by the respective parties, I proceed to pass the following order :

ORDER

(i) Writ Petition stands disposed of as withdrawn. No order as to costs. (ii) The petitioner/management is hereby permitted to withdraw the amount deposited pursuant to the order passed by this Court dated 15.10.2018 along with

2 40-3359-2018WP accrued interest, if any. The amount is lying with the Industrial Tribunal at Aurangabad. The Industrial Tribunal, Aurangabad is hereby directed to make payment to the petitioner accordingly.
