DATE : 22 JULY 2024 ORAL ORDER (MANGESH S. PATIL, J.) :

Heard.

2.

The petitioner's proposal is pending adjudication by the respondent no. 2 - committee for verification. 3.

It appears that the petitioner, in the meantime was admitted in respondent no. 4 - college being run under respondent no. 3 - university. She seems to have appeared at the eighth semester of B.Pharmacy course examination, however, her result has not been declared.

4.

Learned advocate for the petitioner submits that simultaneously, with a direction to the committee to decide the proposal at the earliest, the petitioner may be issued with a marksheet with whatever condition so that she can decide the further course

2 WP /3096 / 2024 depending upon the result. He would further submit that the petitioner would not derive any benefit of reservation either for pursuing further studies or for securing any employment unless the claim is decided finally.

5.

Learned advocate for respondent no. 3 - university submits that if the Court directs, the university can declare the result. 6.

Needless to state that till the time the petitioner is not found entitled to have a certificate of validity, she is not entitled to derive the benefit of reservation either in securing the employment or pursuing further studies. However, she would need the result so that depending upon it, she can decide to appear for the examination, if she has failed.

7.

We dispose of the writ petition by directing respondent no. 2 - committee to decide the petitioner's proposal as expeditiously as possible and in any case within six (6) weeks. 8.

In the meantime, respondent no. 3 - university shall declare the petitioner's result, however, she shall not be entitled to degree certificate or to secure any employment or pursue further studies taking advantage of the reservation.
