The petitioner who is a lab assistant appointed in the respondent no.4 - school, is challenging the decision rendered by respondent no. 2 in his capacity of chairman of the committee constituted under the Government Resolution dated 27-03-2019, thereby refusing to include his name in the Shalaarth Pranali for disbursal of the salary only on the ground that he is appointed from the scheduled tribe category but has not submitted the tribe validity certificate. It is also pointed out that his proposal is pending with respondent no. 5 for verification of the tribe certificate.

Since it is not in the hands of the petitioner to get the proposal pending with respondent no.5 decided, having worked as a lab 1/2

915.WP.3139.25.odt assistant, he cannot be deprived of the salary. 4.

We, therefore, dispose of the petition by directing respondent no.5 - scrutiny committee to decide the petitioner's proposal as expeditiously as possible and in any case within four (4) months. 5.

The respondent no. 2 shall pass appropriate order for including petitioner's name in the Shalaarth Pranali which decision shall be subject to the final outcome of the decision of respondent scrutiny committee.
