The application is filed for relief of quashing of the proceedings in Sessions Case No. 302 of 2014 pending in the Court of Special Judge, Aurangabad and it is filed for offence punishable under sections 323, 234, 354-A (1) (2), 504, 506 read with 34 of the Indian Penal Code and section 11 and 12 of Protection of Children from Sexual Offences Act, 2012. The respondent No.2 has filed affidavit, who is original complainant. It is to the effect

-:(2):- that the parties have settled the dispute. The dispute was of private nature and so the relief of quashing needs to be given. As per the instructions given by this Court, it appears that affidavits of the parents of the minor are also filed and they are to the similar effect. This Court has gone through the record of the investigation and the material collected against the applicant No.1. In view of the dispute and the nature of allegations, this Court holds that application needs to be allowed. So, the application is allowed. Proceeding is quashed and set aside.
