Heard learned advocates for the parties.

Learned advocate for respondent No. 5 points out that there is an alternate remedy available in the form of an appeal pursuant to section 152 of the Maharashtra Co-operative Societies Act, 1960 against order passed under section 21A of the Act.

Having regard to the same, writ petition is not being entertained and is disposed of with liberty to the petitioner to have resort to appropriate remedy as is stated to be available.

While contention of the petitioner is that charge is yet not taken over pursuant to the impugned order, contention on behalf of respondent No. 5 is otherwise stating that charge is already taken over, situation as on the date be maintained till appellate authority passes appropriate order. Petitioner to approach the appellate authority within a fortnight from today. It is expected that appellate authority would pass appropriate orders within a period of four weeks from today.
