IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.4098 OF 2019 (Raosaheb Sitaram Chaudhari Vs. The Competent Authority and another) Mr.P.N.Khedkar, Advocate for the petitioner.

( CORAM : Ravindra V.Ghuge, J.) DATE : 12/06/2019 PER COURT :

1.

Learned Advocate for the petitioner submits on instructions that after he had suffered an adverse order dated 13/11/2018 passed by the Labour Court, by which his application for interim relief in Complaint (ULP) No.22/2015 was rejected, he had approached the Industrial Court by filing Revision (ULP) No.116/2018. By the impugned judgment dated 26/02/2019, the revision petition was dismissed. As he had approached the Labour Court against the second show cause notice, he has now been dismissed from service by way of punishment. He submits that this matter has become infructuous.

2.

In view of the above, this petition is disposed off as being remediless. Needless to state, the petitioner will have a right to challenge the order of dismissal either by amending the pending ULP complaint before the Labour Court or by preferring an independent complaint.
