Applicant seeks regular bail on account of his arrest in crime no.0196 of 2024 registered at Shiradhon Police Station, District Osmanabad, for offence under Sections 409, 420, 465, 467, 471 of the Indian Penal Code.

Pointing to the date of arrest of applicant as 27-01-2025, it is submitted that applicant is working as Post Master. That, there are

{2} BA 436 OF 2025 allegations that he misappropriated amount to the tune of Rs.19,56,499/-. It is pointed out that already applicant has repaid over Rs.7,02,448/-. That, entire investigation pertains to documentary evidence, which are already seized. That, investigation is also over and chargesheet having been filed on 21-03-2025, according to learned counsel, no purpose would be served by further detention of the applicant and hence, he seeks bail on any condition deem fit by this Court.

Learned APP opposed application on the ground that applicant has misappropriated money from depositors under the garb of investing in various schemes. That, more than 24 depositors are cheated. Learned APP apprehends misuse of liberty. According to him, there is life imprisonment for commission of above offence. 4.

Heard. Perused the FIR dated 08-10-2024. One Anand Govindrao Kauthekar has reported that, present applicant, while working as Post Master, misappropriated Rs.19,56,499/-. Entries are taken in the schemes like Sukanya Samrudhi Scheme, Saving Account, Fixed Deposits, but amount is misappropriated. 5.

Out of Rs.19,56,499/-, only amount of Rs.7,02,448/- is said to

{3} BA 436 OF 2025 be repaid. Act of repayment itself shows that alleged amount is misappropriated. Therefore, though chargesheet is filed, when investors' and depositors' amounts are misappropriated by committing forgery and fraud, this Court is not inclined to grant bail at this stage. Hence, following order is passed.

ORDER

Bail Application No.436 of 2025 is rejected.
