We have heard the learned counsel for the petitioner and the learned Assistant Government Pleader.

The learned Assistant Government Pleader points out that the appeal filed by the petitioner is before the Commissioner of Transport and the direction given to file with the criminal case by Assistant Commissioner of Transport. 3.

In light of that, the appellate authority is different. The petitioner may prosecute his appeal with the appellate authority in accordance with law. 4.

The appellate authority shall decide the said appeal expeditiously on its own merits.

The writ petition is disposed of. No costs.
