Leave to amend the prayers of the Civil Application. Amendment be carried out forthwith.

This application is filed in disposed of appeal for bringing heirs on record and permitting those heirs to withdraw the amount of compensation which is lying in the High Court. 3.

Respondent - Insurance Company had filed First Appeal No.1072/2016 in this Court. The original claimant had also filed appeal. The Insurance Company had deposited amount in the Court. Later on First Appeal was withdrawn by the Insurance Company. The amount deposited in this Court remained to be disbursed either to the original claimant or to his heirs.

In the present application, it is brought to the notice of this Court that original claimant died on 29.04.2023. The heirship certificate annexed to the application indicates that Applicant Nos. 1 to 5 are the heirs of the deceased - Parshuram Bhijai @ Bhikaji Pawar.

Considering peculiar facts and circumstances of the case, I deem it appropriate to allow the present application in terms of prayer clause 'A-1' and 'B'. First Appeal is already withdrawn. The heirs of the original applicant are entitled to receive the amount with accrued interest which is lying in the High Court. I, therefore, pass following order :

ORDER

(i) The Application stands allowed in terms of prayer clause 'A-1' and 'B'.

(ii) The office shall forthwith disburse the amount. (iii) Amendment be carried out in the appeal memo.
