IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 916 WRIT PETITION NO.3891 OF 2022 SURYAKANT SAYANNA MUNDLOD AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA AND ANOTHER ....

Mr Apparao Yenegure, Advocate for petitioners; Mr S. B. Yawalkar, A.G.P. for respondents/State CORAM : RAVINDRA V. GHUGE AND ANIL L. PANSARE, JJ.

DATE : 14th June, 2022 PER COURT:

1.

The petitioners have put forth prayer clause (B), which reads as under :- "(B) By issuing Writ of Certiorary or any other appropriate writ or directions in the like nature, be please to quashed and set aside the Show Cause Notice dated 18/08/2021, issued by the Respondent No.2 Scheduled Tribe Certificate Scrutiny Committee, Aurangabad."

2.

We find from the impugned show cause notice that the Competent Committee has called upon the petitioners to show cause, as to whether the validity certificates issued with reference to the 'Mannervarlu' Scheduled Tribe should be rejected or not. They were granted time till 06/09/2021 by the impugned notice,

3891.22wp (2) dated 18/08/2021. This petition has been filed on 06/03/2022. 3.

Considering the above, we do not find that our extraordinary writ jurisdiction should be exercised in matters, wherein a show cause notice is issued, calling for an explanation. In the event of further orders being passed and if adverse to the petitioners, they can avail of a legal remedy. 4.

In view of the above, this petition is disposed off, with liberty to avail of a remedy, as may be permissible in law. (ANIL L. PANSARE, J.) (RAVINDRA V. GHUGE, J.) sjk
