We have heard the learned counsel for the petitioner. The learned counsel submits that, the petitioner is orthopedically handicapped and also comes from V.J.A. category. The petitioner was appointed as Assistant Teacher on 20.02.2001. The case of the petitioner for promotion was not considered. The petitioner gave representation to the Chief Executive Officer on 20.01.2005. Three per cent reservation given for physically handicapped persons is not followed by respondents.

The learned counsel for the Zilla Parishad submits that,

2 wp 2917.15 the petitioner stands at Sr. No. 8 and 3% reservation for handicapped category is maintained scrupulously. 3.

It is for the authorities to consider about the seniority, so also 3% reservation for physically handicapped category being followed and adhered to. The petitioner has raised an objection in that regard vide his application dated 20.01.2005 (Exhibit - G). 4.

The petitioner may make fresh comprehensive representation with the respondents. The respondent No. 3 shall consider said representation and take decision afresh as regards the seniority of the petitioner expeditiously on its own merits and according to law preferably within six (06) months from the date of receipt of the representation. The writ petition is disposed of. No costs.
