After hearing submissions at bar, learned Counsel for respondent No. 1 - Trust, conceded that the enquiry Committee could not have been convened by respondent No. 2, against whom serious allegations were made by the petitioner before commencement of the enquiry. Mr Kazi stated that
WP2149.2013 respondent No. 1 - Society would reconstitute the Committee in which members would not have bias against the petitioner. Mr Kazi also informed that Mr L. G. Kale has left the Committee and he is replaced by one Mr Shah Hasan Razzaq, who is an awardee teacher.

In view of the statement made by Mr Kazi, learned Counsel for respondent No. 1 - Trust, the petitioner's grievance is almost mitigated. The enquiry against the petitioner shall start de novo and petitioner should cooperate with the same.

Writ Petition stands disposed of accordingly. 4.
In view of disposal of writ petition, connected Civil Application does not survive and stands disposed of.
