The applicant has been convicted for the offence punishable under Section 304 Part I of the Indian Penal Code, and therefore, sentenced to suffer rigorous imprisonment for ten years and fine of Rupees One Thousand. In default of payment of fine amount, he has been directed to undergo rigorous imprisonment for two months. Against this quantum of sentence, he has been behind the bars for little over four years. 3.
Learned A.P.P. would submit that there are four dying declarations, two oral and two written.

Considering the quantum of sentence imposed and the fact that the appeal is not likely to come up for hearing in immediate future, the execution of substantive sentence of imprisonment to stand suspended pending the appeal. The applicant be released on his executing P.R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety in the like amount.
