Advocate for Applicant : Mr. Jadhav Yogesh H. APP for Respondent: Mr. S D Ghayal (in all applications)
CORAM : V.K. JADHAV & SANDIPKUMAR C. MORE, JJ. Dated : April 29, 2022 ...
PER COURT :- 1.
Heard both sides.
2.
This Court by order dated October 14, 2020 in Criminal application no.1283 of 2020 and in the connected applications, pending the criminal appeal/s preferred against the judgment and order of conviction released the applicants on bail on certain conditions. So far as condition (D) is concerned, the applicant/s before us have been directed to report the Parole Police Station on every Sunday between 11.00 am to 1.00 pm and their attendance would be marked by S.H.O. by obtaining their signatures in the station diary.
3.
The learned APP has placed before us the attendance sheet, wherein column nos.4 and 5 pertains to the 'attendance' and 'no-attendance', respectively. It appears from the said attendance-sheet that the attendance is recorded on almost all the dates and last column about 'no-attendance' is blank with no entry in
it. It thus appears that the applicant/s have complied with the condition 'D' in paragraph no.22 of the order. 4.
All the applicants were on bail during the trial and even after their conviction they have been released on bail by this Court with certain conditions.
5.
In view of the same, in our considered opinion, condition 'D' requires modifcation. We accordingly modify the condition no.(D) to the effect that each of the applicant/s shall report at the Parole Police Station on FIRST SUNDAY in between 11.00 a.m. to 1.00 pm ONCE IN THREE MONTHS and their attendance would be marked by S.H.O. by obtaining their signatures in the Station Diary. With this modifcation as above, all the Criminal Applications are accordingly disposed off. ( SANDIPKUMAR C. MORE, J. ) ( V.K. JADHAV, J. )
