Applicant seeks grant of regular bail on account of his arrest in crime no.0842 of 2024 registered with Shevgaon Police Station, District Ahmednagar, for offence under Sections 420, 409, 406 read with 34 of the Indian Penal Code (IPC) and Section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act (MPID Act).

Learned counsel submitted that applicant is arrested in above crime on 29-10-2024 and he is behind bars since then. That, there

{2} BA 451 OF 2025 are allegations that some Directors and Officers of Matrutirtha Sindhkhedraja Urban Co-operative Society, Shevgaon, were inviting deposits by assuring huge returns by way of interest and informant claims that he was cheated. Learned counsel submitted that applicant has no concern with the said Society. That, he is neither a Director nor he is shown to be office bearer. That, main accused is Dipaksing Babusing Chavan and he is still absconding. That, applicant is behind bars since almost six months. That, main accused is at large. That, as applicant did not collect or recover any amount, he prays for grant bail on any condition deem fit by this Court. 3.

Learned APP fairly pointed out that though crime is registered, so far as applicant is concerned, no role is attributed to him and allegations of collection of money is directed against Dipaksing Babusing Chavan.

Considering the aforesaid submissions, relief as prayed deserves to be granted. Hence, following order :

ORDER

(i) Bail Application is allowed.

{3} BA 451 OF 2025 (ii) Applicant Mohan Rustum Maghade be released on bail in connection with Crime no.0842 of 2024 registered with Shevgaon Police Station, District Ahmednagar, on executing Personal Bond of Rs.15,000/- with one surety in the like amount.

(iii) Applicant shall not tamper prosecution evidence. (vi) Applicant shall not leave the jurisdiction of concerned Police Station, till conclusion of trial, except for attending Court dates.

(v) Applicant shall report to concerned Police Station, twice in a week i.e. on every Tuesday and Thursday till commencement of trial and thereafter, he shall regularly attend each and every effective date before the trial Court. ( ABHAY S. WAGHWASE ) JUDGE SPT
