Heard the learned counsel for the applicant and the learned A.P.P for the respondent/State.

The applicant has been arraigned as an accused as the medical consignment was sent in the name of his shop. However, he did not have a shop on the address mentioned om the consignment. He runs his business from house. The applicant had no concern with the alleged consignment. Nothing has been discovered in the investigation. The material investigation has been completed. The applicant has roots at Ahmednagar. There are no antecedents to his discredit. Hence, he deserves bail.

ORDER

(i) The application is allowed.

(ii) Applicant Nitin Jagannath Bothe be released on bail on furnishing P.B.and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in C.R.No.325 of 2022 registered with MIDC Police Station, Ahmednagar, for the offences punishable under Sections 18(A), 18(C), 22, 27, 28 of the Drugs and Cosmetics Act, 1940 and Sections 420, 468, 471 read with Section 34 of the Indian Penal Code, on the conditions that, (a) He shall not to tamper with the prosecution witnesses. (b) He shall attend the Police Station as and when called by the Investigating Officer on written notice till filing chargesheet. ( S. G. MEHARE ) JUDGE ysk
