Mr.Latange, learned counsel for the Appellant submits that the appellant and respondent No.1 i.e. the complainant and accused have settled the subject matter of appeal out of Court. He submits that he has received instructions from the appellant to withdraw the Appeal. Pursis filed to that effect taken on record and marked as 'X' for identification.

The present appeal pertains to acquittal of accused for the offence punishable under Section 138 of the Negotiable Instrument Act. Offence is compoundable. In view of settlement between the parties, no cause survives to proceed with appeal. The Appeal is disposed of as dismissed for want of prosecution.
