The applicant is seeking quashment of a crime registered during the pandemic in view of the lockdown involving several offences under Indian Penal Code, the Epidemic Diseases Act and Maharashtra Police Act etc. 2.

Learned APP places across the bar a Government Resolution dated 20 September 2022 laying down the modalities for withdrawing the prosecution.

We dispose of the Criminal Application to enable the applicant to approach the trial court and claim benefit under this Government Resolution with the liberty to approach this Court, in case the prosecution is not withdrawn.
