Heard learned Counsel for applicants and learned Counsel for respondent No.2.

Learned Counsel for applicants submits that, deceased Akshay was son of applicant Nos.1 and 2. He was Karta of the family. Applicants are old aged and they do not have other source of income. They needs amount for their daily expenses. Hence, requested to allow the application.

Learned Counsel for respondent No.2 submits that, respondent No.2 has challenged the impugned order on various grounds, one of the ground is that false involvement of ofending vehicle. Hence, requested to dismiss the application.

I have heard both the learned Counsel.

Applicants are parents of the deceased. They have no other source of income. They needs amount for daily expenses as well as for medical purpose. Hence, I pass following order :

ORDER

a.

Applicants are permitted to withdraw 50% amount along-with accrued interest thereon on furnishing undertaking before learned Registrar (Judicial).

b.

The Civil Application is disposed of.
