The Petitioner has been working as Vanmajoor (Forest Majoor) since 01-11-1994. Since he was terminated from service, he preferred complaint (ULP) No.10/2015 before the Labour Court, Dhule. By an interim order dated 08-05-2015, his service was protected and he was continued in employment. The complaint was eventually allowed by the judgment dated 20-032019. In the meanwhile, the Petitioner has filed Complaint (ULP) No.33/2016 seeking declaration that he is eligible for

(2) absorption. By judgment dated 31-07-2018, the learned Industrial Court allowed Complaint (ULP) No. 33/2016. The Forest Department approached the High Court in Writ Petition No.7553/2021. By the judgment dated 20-08-2021, Writ Petition No.7553/2021 was partly allowed only to the extent of the cost imposed by the learned Industrial Court. The conclusion as regards absorption of the petitioner was not interfered with. Besides this history of litigation, certain Misc. Applications have also been filed.

Reason for the Petitioner to approach this Court is, the pendency of his Application for seeking regularization and arrears of salary, with the government.

The Additional Principal Chief Conservator of ForestRespondent No.3 herein has addressed a communication dated 12-08-2022, favourably recommending the case of the Petitioner to the Principal Secretary (Forest) Revenue and Forest Department Mantralaya Mumbai, and the same is still pending.

In view of above, this Writ Petition is disposed off with a direction to Respondent No.1 to deal with the said proposal dated 12-08-2022, forwarded by Respondent No.3, within a period of 45 days and communicate the decision to the Petitioner within 15 days.

Compliance of this order shall be reported to this Court on 03-05-2024.
