This is the Application for condonation of 188 days delay in preferring First Appeal by the Acquiring Body against the Judgment and Award dated 17.04.2019 passed by learned Jt. Civil Judge Senior Division, Osmanabad in LAR No.256/2016.

The learned Advocate for the Applicant submits that due to procedural aspect in seeking sanction at various levels and lock-down due to COVID-2019, the Appeal could not be preferred within the stipulated time. He submits that delay may be condoned and the Application may be allowed.

None appears for Respondent Nos.1A to 1D / Original Claimants, though served.

The learned AGP for Respondent Nos.2 and 3 submits that appropriate orders may be passed.

On bearing both the sides and for the reasons mentioned in paragraph nos.2 to 4 of the Application, the Application is allowed in terms of prayer clause '
