Heard rival submissions.

The applicant is seeking recalling of the order dated 23.11.2007 whereby registration of his first appeal was refused for non-removal of office objections. There is also a huge delay of 5548 days for filing this application and in the meantime, the appeal memo and annexures were also destroyed. The learned counsel for the applicant undertakes to reconstruct the documents and to remove all the office objections within six weeks.

In view of the same, the order dated 23.11.2007 stands recalled and the appeal after reconstruction be restored for removal of all the office objections within six weeks subject to

(2) 913 CA-5316.2023.odt deposit of cost of Rs.10,000/- to be paid to the Library, Advocates Association of High Court, Bombay, Bench at Aurangabad. It is made clear that the applicant shall not claim any interest for the aforesaid period of delay of 5548 days on the enhanced compensation amount, if granted. 4.

Application is disposed of accordingly.
