The learned Counsel for the petitioner seeks permission to withdraw the petition with liberty to file fresh application for joint measurement of adjoining lands belonging to petitioners and respondents at an appropriate stage after leading foundational evidence for the same, in view of the fact that the application for appointment of Commissioner is rejected on the ground that it was filed before the petitioners/plaintiffs have led their evidence in the matter. 2.
