The petitioner was directed to deposit measurement fees under letter dated 02.12.2021. The Deputy Superintendent of Land Records has filed affidavit to that effect. The Tahsildar has also filed affidavit to the effect that, he has redirected respondent no.3 for measurement of Gut No.121, 122 to open Shiv Road and on receipt of measurement fees the said exercise would be done. 2.

Mr. Deshpande, learned counsel for petitioner submits that, he is ready to pay the measurement fees. 3.

The petitioner shall pay the measurement fees as required for the measurement within a period of 15 days from today. Thereafter, the measurement shall be carried out in accordance with law and by adhering to the procedure as laid down under the statute and rule.

It is made clear that, we have not considered the merits of contentions of either of the parties. It is open for the parties to take up appropriate proceeding before the appropriate authority if any orders adverse to their interest are passed. 5.

Writ Petition is disposed of. No costs.
