Notices on the legal heirs of the deceased respondent no.3 have already been served. An appearance is entered on behalf of the legal heirs. The learned advocate is absent.

I have heard the learned advocate for the applicant and have perused the reasons cited in the Civil Application seeking condonation of delay of 962 days.

For the reasons stated, this Civil Application is allowed. The applicant/ petitioner shall deposit costs of Rs.1500/- (Rupees Fifteen Hundred) as donation for the Ghati Hospital, Aurangabad (Government Medical College and Hospital, Aurangabad), to be deposited with the Medical Officer, High Court Dispensary, Aurangabad, either in cash or by

*2* 962ca3896o19 Demand Draft, to be drawn in the name of "Dean, Government Medical College and Hospital Dengi Samiti, Aurangabad" and produce a receipt of such deposit before the Registry of this Court on or before 11.11.2019. Thereafter, the legal heirs of the deceased respondent no.3 shall be brought on record in the writ petition.

If the above direction is complied with, the interim relief granted earlier would continue.
