Heard Mr. M.V.Salunke, the learned counsel for the applicant and Mr. A.S.Shinde, the learned A.P.P. for respondent - State.

This is an application for suspension of substantive jail sentence and for grant of bail. 3.

The applicant is convicted by the learned Sessions

2 Cr.Apln. 1286.2015 Judge Beed in Sessions Case No. 36/2013 for the offence u/s 326 of the Indian Penal Code and directed to serve the jail sentence for three years and to pay fine of Rs. 5,000/- [Rupees Five Thousand].

The learned counsel for the applicant submitted that the learned Sessions Judge on 02/03/2015 has already suspended the jail sentence in order to enable the applicant to approach this court. He submitted that the fine of Rs. 5,000/- is already deposited by the applicant. Statement accepted. 5.

Looking to the limited duration of the jail sentence and in view of the fact that in near future, the court will not be able to take final hearing of the present Criminal Appeal, in the interest of justice, the substantive jail sentence as imposed by the learned Sessions Judge, Beed on 02/03/2015 in Sessions Case No. 36/2013 shall stand suspended till the decision of the present Criminal Appeal. 6.

The applicant Ashok @ Bali S/o Annarao Sonar shall be released on the same bail, however fresh bonds to be executed before the learned Sessions Judge, Beed. 7.

Criminal Application No. 1286 of 2015 is disposed of.
