The learned counsel for the petitioner states that, validation proceedings in respect of tribe claim of the petitioner are pending with the Committee. The respondent No. 3 college is not allowing the petitioner to appear for examination. 2.

Mr.

Patil, the learned counsel for the respondent/Committee states that, it would take some time to decide validation proceedings. The learned A. G. P. submits that, as the validity certificate is not filed, the petitioner cannot prosecute further studies and take benefit of reservation.

To get the proceedings decided within a stipulated time is not within the hands of a litigant.

Considering the above, we pass the following order. 5.

The respondent No. 4/Committee shall decide the validation proceedings in respect of tribe claim of the petitioner expeditiously and preferably within a period of one (1) year from today. The petitioner shall cooperate in expeditious disposal of the validation proceedings. Till the validation proceedings are decided, the respondents shall not refrain the petitioner from prosecuting further studies and appear for examination only on the ground that validation proceedings are pending. Of course, the respondent/college can take further steps in tune with the judgment and order passed by the Committee in the validation proceedings. The writ petition is disposed of. No costs. [ V.
