Per Court :- Present Criminal Application is filed by the applicant for grant of anticipatory bail, since he is apprehending his arrest in connection with CR No. 48/2015 registered with Pathardi Police Station, Dist. Ahmednagar for the offences punishable under Section.s. 363, 366, 376(d), 109 and 114 read with 34 of the Indian Penal Code.
[2] Heard Mr. R.G. Hange, learned counsel for the Applicant and Mr. A.S. Shinde, learned Additional Public Prosecutor for the State in extenso.
2/3 [3] From the First Information Report, it is clear that the prosecutrix, who is 21 years old, has travelled on her own accord, in a jeep. Further looking to the accusation and nature of the allegations made in the First Information Report itself against the present applicant is concern, it is clear that present applicant is the friend of accused No.1. Further the learned Additional Public Prosecutor has made available to me the statement of prosecutrix dated 11/02/2015 recorded before the revenue officer, which clearly shows that, she has not ascribed any role against the present applicant. [4] In that view of the matter, present application needs to be allowed, since custodial presence of present applicant is not at all necessary. So far as apprehension of the learned Additional Public Prosecutor that yet Charge-Sheet is to be filed, said can be taken care by imposing certain conditions on the applicants. Hence, I pass the following order :-
ORDER
(i) Criminal Application is allowed.
(ii) In the event of arrest, applicant - MAHADEO DADASAHEB KHEDKAR shall be released on anticipatory bail on he executing P.R. Bond of Rs. 5000/- [Rs. Five Thousand] with one solvent surety in the like amount, in connection with CR No. 48/2015 registered with Pathardi Police Station, Dist. Ahmednagar for the offences punishable under Section.s. 363, 366, 376(d), 109 and 114 read with 34 of the Indian Penal Code.
3/3 (iii) The applicant shall attend Police Station, Pathardi, Dist. Ahmednagar twice in a week preferably on every Wednesday and Saturday between 3.00 p.m. to 4.00 p.m. (iv) With this Criminal Application is disposed of. (V.M. Deshpande, J.)
