IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.3274 OF 2019 DNYANRAJ S/O SANTAJI GHORPADE

VERSUS

THE STATE OF MAHARASHTRA AND ANOTHER Mr. S.G. Jadhavar, Advocate for the petitioner Mr. S.S. Dande, AGP for the respondents/State Mr. D.M. Shinde, Advocate for respondent No.3. CORAM : PRASANNA B. VARALE & S.M.GAVHANE,JJ.

DATED :

08.03.2019 PER COURT :- 1.

Heard learned counsel for the petitioner.

2.

Learned counsel for the petitioner fairly submitted before us that, though in the petition the prayer clauses (B) and (C) are in the nature of seeking directions to conduct an enquiry and in the nature of restrainment order, the petitioner is not pressing those prayers but the petition is requesting this Court to issue directions to decide a representation which is pending before the Competent Authority i.e. respondent 1/ 3

No.2-the District Collector, Parbhani expeditiously. 3.

This being a submissions of the learned counsel, without referring to the contentions raised in detailed in the petition, we deemed it appropriate to dispose of the writ petition at the admission stage with directions.

4.

Issue notice to the respondents, returnable forthwith. Learned AGP waives service of notice for respondent Nos.1 and 2. Mr. D.M. Shinde, waives service of notice for respondent No.3.

5.

A representation is submitted to the office of Collector and accepted by the office of the Collector on 28.02.2019 raising certain grievances against issuance of e-tender. The grievance further seems to be of non following of the procedure set out by the Government in Government Resolution dated 25.09.2018. The District Collector, Parbhani-respondent No.2, thus, is directed to decide the representation as early as possible and not later than 12 weeks from the date of order of this 2/ 3

Court, needless to state on the merits of the representation.

6.

With the above directions, the writ petition is disposed of.
