Mr Mukhedkar, learned Counsel appearing on behalf of complainant-respondent No. 2 submits that complainant has expired and as such, the complaint is rendered infructuous. 2.

In view of above, in my opinion, the order impugned in the present proceedings is not sustainable. Hence, same is set aside. 3.

The legal heirs of the complainant will be at liberty to take steps as are available and permissible in law.
