BENCH AT AURANGABAD 96 WRIT PETITION NO.3201 OF 2023 AKHILESH SATISH SONARIKAR ALIAS AKHILESH SATISHRAO SONARIKAR

VERSUS

THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS .....

Advocate for Petitioner : Mr. Amit A. Mukhedkar AGP for Respondent Nos. 1 and 3: Mr. S.P. Tiwari Advocate for Respondent Nos. 2 : Mr. S.B Pulkundwar .....

CORAM : RAVINDRA V. GHUGE AND SANJAY A. DESHMUKH, JJ.

DATED : 23rd MARCH, 2023.

PER COURT :- 1.

The Petitioner's case before us is that his father's name is actually "Satish" and which has wrongly been mentioned as "Satishrao" in his school record.

2.

We have perused the entire record of the Petitioner's father placed before us. It is obvious that his name has always been mentioned as "Satish" right from his schooling days. Even now he continues to carry his name as "Satish". However, in the school record of the Petitioner, his father's name was wrongly entered as "Satishrao".

3.

In view of the above, the impugned order dated 8.6.2022, passed by Respondent No.3, Education Officer, is quashed and set

wp3201.23 -2aside. The said proposal No.23, dated 27.5.2022, is restored to the file of the Education Officer. Considering the law laid down by the learned Full Bench of this Court in Janabai Himmatrao Thakur vs. State of Maharashtra and others, 2019 (6) Mh.L.J. 769, (paragraph 39), the Education Officer would correct the name of the Petitioner's father by deleting the word "rao". Let such exercise be completed on or before 15.4.2023. Thereafter, by following the due procedure, the Maharashtra State Board of Secondary and Higher Secondary Education, Pune and Latur i.e. Respondent Nos.6 and 7, shall make necessary corrections in it's record and issue corrected certificates to the Petitioner, on or before 30.04.2023.

4.

With the above directions, the Writ Petition is disposed off. (SANJAY A. DESHMUKH, J.) (RAVINDRA V. GHUGE , J.) rlj/
