We have heard Mr. Biradar, learned Counsel for the petitioner, the learned A.G.P. for the respondents and the learned Counsel for intervenor.

The petitioner is seeking directions to allot the fair price shop to the petitioner without sending the proposal to Women Gram Sabha. Reliance is placed by the petitioner on the order dated 20.01.2021, thereby setting the Circular dated 15.01.2021 till 31.03.2021.

It is submitted that the learned A.G.P. has placed on record the order passed by the Deputy Commissioner (Supply), Aurangabad dated 08.07.2021 wherein he has set aside the order dated 20.01.2021 passed by respondent no. 2 herein. 4.

It is submitted that the petitioner has already challenged the order i.e. 08.07.2021 by filing a writ petition and the same is pending before the learned Single Judge of this Court. 5.

As the order passed by the Deputy Commissioner (Supply), Aurangabad dated 08.07.2021 is already assailed by the petitioner by filing the writ petition and the same is pending before the learned Single Judge, it will be open for the petitioner to raise all the points as raised in the present writ petition in the writ petition filed by the petitioner challenging the order dated 08.07.2021 passed by the Deputy Commissioner (Supply), Aurangabad.

Keeping all points and contention of the petitioner, the respondents and the intervenor open, the present writ petition is disposed of with the aforesaid observations. No costs.
