This appeal is moved by the Government challenging judgment and award dated 02.02.2002 passed by the learned Additional District Judge, Jalgaon in LAR No. 356 of 2001. By way of the judgment, the learned Reference Court has enhanced amount of compensation. 02.

The learned AGP submits that all the appeals are arising out of same acquisition proceeding and same common judgment bearing First Appeal Nos. 930 of 2002, 920 of 2003, 918 of 2003, 976 of 2009 were disposed off by National Lokadalat held on 30.11.2024, in view of Government Resolution dated 03.11.2016 with Corrigendum dated 23.02.2017. The Government took a decision not to file appeal, where the amount of compensation is enhanced by less than four times of the amount awarded by the Special Land Acquisition Officer.

In the present case, it is seen that the appeals arising out of same judgment and acquisition proceedings, are already disposed off before the National Lokadalat. Therefore, considering the same, nothing survives in the present appeal, as the amount of enhancement of compensation is less than four times. The Special Land Acquisition Officer had granted rate of Rs. 3,50,803/- per hectare, which is enhanced to Rs. 4,00,000/- per hectare. So far as compensation towards trees is concerned, learned AGP informs that there is no dispute about the same. 04.

Considering the above this First Appeal is dismissed with no order as to costs.
