The petitioner is a widow of a freedom fighter. Her husband made an application for freedom fighter's pension way back in the year 1995. Meanwhile, he passed away. The petitioner has therefore filed the present petition. It is stated to be fourth round of litigation.

Be that as it may, learned advocate for Union of India and learned AGP submits that, if the petitioner makes an application complete in all respect and accompanied by necessary documents first to the State Government, the same would be forwarded to the respondent/Union of India for deciding the same. It has also been informed that the petitioner is receiving freedom fighters family pension from the State Government.

In view of the above, the petition stands disposed of in terms of the following order;

(i) If the petitioner makes an application of freedom fighters pension along with necessary documents, the same shall be forwarded by the respondent/State forthwith to the respondent/Union of India. (ii) The respondent/Union Government shall decide the said application within a period of four months from the date of receipt thereof. It shall not reject the same on technical reasons such as the application has not been filled in completely or one of the necessary documents is not forthcoming. In such a situation, the authorities concerned shall call upon the petitioner to submit necessary documents.

(iii) We also expect the State authorities to give full co-assistance to the petitioner in making and even forwarding her application, since the petitioner is stated to be 85 plus.
