PER COURT:- 1.

The caste certificate of the petitioner is forwarded for verification to the Scrutiny Committee in the year 2010. It is submitted that the same is still pending with the Committee. The petitioner is appointed on the post of Clerk-Typist (Junior) as against Scheduled Tribe category by respondent no.2. The respondent no.2 has issued notice directing the petitioner to produce the validity or else his services would be terminated. 2.

It is submitted that the vigilance is not yet concluded.

To get the proceedings decided within stipulated period is not in the hands of the litigants. The vigilance has to be conducted by the officers.

Considering the above, we pass the following order:

ORDER

(i) The respondent no.3-Committee shall decide the validation proceedings in respect of the tribe claim of the petitioner expeditiously and preferably within a period of four (04) months from the date of the appearance of the petitioner.

(ii)The petitioner shall appear before the Committee on 21.11.2018 and shall cooperate in expeditious disposal of the proceedings.

The respondent no.2 shall not take adverse action against the petitioner only on the ground that the validation proceedings are pending.

Depending upon the judgment delivered by the committee in the validation proceedings, the respondent no.2 may take further course of action. 7.

Writ Petition accordingly disposed of. No costs.
