Perused the record and proceedings. The objection notified by the office is that notice issued to the sole respondent Sheshrao s/o Patloba Kendre is returned unserved on the ground that, he is reported to be dead. The bailiff report filed on record clearly indicates that, Sheshrao Kendre died on 28/08/2004. Thereafter, no steps have been taken by the appellant to bring on record the legal heirs of deceased respondent, if any. Thus, it appears that, appellant is not really interested in taking steps and to proceed further with this appeal. Hence order,

ORDER

The appeal against sole respondent stands abated.
