I have heard learned counsel for the petitioner for some time. It appears that the Additional Divisional Commissioner, by the impugned order dated 06.11.2020, has remanded the matter to the Collector by setting aside the order passed by the Collector dated 28.01.2020. In view of the same, there is no question of declaring any election programme as such. The apprehension expressed by the learned counsel on behalf of the petitioner is thus not well founded. Apart from this, the learned AGP, as directed to him, has taken instructions and informed this Court that after remand, the Collector has not proceeded with the vre/-

902-WP-5695-2021.odt enquiry and so far as clause no. 3 of the operative part of the impugned order passed by the Additional Divisional Commissioner, Aurangabad is concerned, no steps have been taken so far to fill up the post.

In view of the above, learned counsel for the petitioner, on instructions, seeks leave to withdraw this Writ Petition.

Leave granted. The Writ Petition is disposed off as withdrawn.
