Heard the learned AGP for appellant and learned Advocate for respondent. In the instant case, the Special Land Acquisition Officer has granted compensation of Rs.16,537/- per Hector i.e. Rs.165/- per R and the same is enhanced by the Reference Court to Rs.320/- per R. 2.

The learned AGP submits that since the enhancement for acquired lands are of rural areas and the enhancement is not more than four times, the Government Resolution dated 03/11/2016 and 23/02/2017 would be applicable to the facts in the present appeal. 3.

In terms of the aforesaid Government Resolution, the Government has taken a policy to not to challenge the Reference Court award where the enhancement is not more than four times in the rural areas and not more than two times in the urban areas. The aforesaid

204 FA 1393-2003 Government Resolutions are also applicable to the pending Appeals. The present matter is covered within aforesaid Government Resolution. 4.

In view of the same, the present First Appeal is dismissed applying the aforesaid Government Resolution. ( ARUN R. PEDNEKER, J. ) vj gawade/-.
