Heard learned counsel for the applicant and learned APP for the State.

The complainant was a journalist. He had published a news on illegal business of transporting refilled gas cylinders. In consequence thereof, the incident happened. It has been alleged against the applicant that he took the complainant forcibly on bullet (a bike) to the office of co-accused, who assaulted him with hockey sticks and caused fracture injury. The allegations against the applicant have been levelled that he snatched golden chain from the neck of the first informant. He also snatched his mobile handset. 3.

The applicant was arrested in the month of January. He has undergone the police custody but nothing is recovered from him. There are no allegations that the applicant has used the weapon to cause the injury to the first informant.

Considering the role attributed to him and the length of his jail along with the material progress in the investigation against him, it would be inappropriate to keep him behind bar. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Rama @ Pintya @ Ravan Ananda Bhusanar, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with Crime No.817 of 2022, registered with Nandurbar Police Station, District Nandurbar for the offence punishable under Section 326, 365, 392, 506 r/w 34 of the Indian Penal Code and Section 37(1)(3) and 135 of Maharashtra Police Act, on the conditions that he shall not tamper with the prosecution witnesses and shall not involve in similar crime.

(iii) The applicant shall attend the concerned police station as and when called on written notice by the investigating officer, till filing charge sheet.
