O R D E R

(09 th SEPTEMBER, 2023) 1.

This appeal is placed before us in today's National Lok Adalat. Mr. Bide learned counsel for the appellants and Mr. Bagal, the learned counsel for respondent No. 3/ Insurance Company are present. On behalf of Insurance Company Mr. R.K. Saitwal is personally present before the National Lok Adalat.

The learned Advocates for both the parties submit that they have amicably settled the lis and accordingly placed on record compromise terms. The compromise terms are

marked as Article "X" for the purpose of identification. 3.

The appellants/Insurance Company shall deposit the enhanced amount of compensation of Rs. 2,75,000/- within a period of 45 days from the date of receipt of this award in the MACT, Ahmednagar in terms of compromise.

The appellants/Claimants are entitled to withdraw an amount of enhanced compensation Rs. 2,75,000/- (Two Lakhs and Seventy Five Thousand) in terms of award passed by this National Lok Adalat from the learned MACT, Ahmednagar on its deposit.

5.

The Chairman/Member, MACT, Ahmednagar shall adjust that statutory amount if any, withdrawn earlier, in the amount of compensation and thereafter take necessary steps for making the payment.

6.

The Chairman/Member, Motor Accidents Claims Tribunal Ahmednagar be informed accordingly.

7.

The Court fee refund certificate be issued as per the provisions under the Maharashtra Court Fees Act, 1959.

8.

The appeal stands disposed off in term of the compromise.
