Present application has been filed by the original claimants for getting the delay of 21 days condoned in filing first appeal. The claimants intend to challenge the judgment and award passed by the learned Member Motor Accident Claims Tribunal, Dhule for enhancement. Learned Advocate for respondent No.3 has strong objection to allow the application.

Taking into consideration the duration of the delay and the fact that the claimants are the widow and minor children of the deceased, the delay stands condoned.
