ORAL ORDER :

By this petition, the petitioner has challenged the order of transposition passed by the Joint Charity Commissioner, Pune, on an application filed by respondent No.2/original applicant bearing Application No. 54 of 2017 on 8 February 2018. By this order, the Joint Charity Commissioner has permitted to transpose respondent No. 7 as applicant No.2 and consequential amendment.

The learned Counsel for the petitioner has contended that these orders ought not to have been passed as it amounts to make the application maintainable.

In the orders passed today in Writ Petition No. 5439 of 2018 with Writ Petition No. 5581 of 2018 in respect of other challenges of the petitioner, I have kept them open to be considered at the time of hearing of the proceedings before the Joint Charity Commissioner. Considering that the Charity Commissioner is ceased with the matter will ultimately decide all the contentions raised by the parties, it will be appropriate that whatever contentions petitioner wants to raise about the transposition he may raise the same before the Charity Commissioner during the course of the inquiry and final conclusion thereof.
