Mr. Sonavane, learned counsel for the petitioners submits that in Rasta Case under Section 5 of the Mamlatdar Courts Act, the petitioners are the defendants. The petitioners have filed application on 7th March, 2017 before the Tahsildar, Newasa, for inspection of place. It is further submitted that no

2 WP 3400/17 orders are passed by the concerned authority and the matter is kept for final argument.

Learned A.G.P. states that the authority before whom the said proceeding is pending would decide the application 'EXH-C' on its own merits. In view of the said statement, Writ Petition is disposed of. No costs.
