( 1 ) 902 sa 340.12
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 902 SECOND APPEAL NO.340 OF 2012 DILIP DEORAO NARWADE AND ANR
VERSUS
KAILASH DEORAO NARWADE AND ORS ...
Advocate for Appellants : Mr. Narendra V. Mande Advocate for Respondents : Mr. Vaidya Ameet R. ...
CORAM : M.G. SEWLIKAR, J.
DATE : 17.12.2019 P.C. :- Heard Shri N.V. Mande the learned counsel for the appellant and Shri A.R. Vaidya the learned counsel for teh respondents. 2.
Both the Courts have concurrently held that the suit property was not the joint family property of the appellants and the respondent no.1. Shri Mande argued that there is presumption that the consideration had flown from joint family funds as the purchaser i.e. respondent no.1 was a minor at the time of execution of the sale-deed. There is no such pleading and therefore appeal is devoid of any substance. No substantial question of law is made out. Hence the appeal is dismissed.
