We appreciate the submission of the learned Advocate for the petitioner that this petition was filed in view of the fact that the Debt Recovery Appellate Tribunal was not available for the State of Maharashtra.

However, now the learned Debt Recovery Appellate Tribunal at Mumbai, is available and the petitioner can, therefore, approach the said authority in view of the statutory appellate remedy being available.

As such, we permit the petitioner to withdraw this petition and avail of the statutory remedy. In the event of any delay, the
