We have heard the learned advocate for the petitioner and the learned A.P.P.

The petitioner is an under trial prisoner. The special case is pending before the Special Court. Since a piece of evidence is not forthcoming, the trial has been held up. He is seeking temporary bail and has filed an application at Exh. 48 before the Special Court. It appears that though the learned prosecutor has submitted his response to the application, seeking bail, no final order is being passed.

The learned advocate for the petitioner submits that the petitioner would be satisfied if a direction is given to the trial court to pass appropriate order on his application (Exh. 48) expeditiously. 4.
