Heard learned counsel for the applicant and learned APP for the State.

The wife of the applicant had extra marital relationship with the deceased. The applicant was knowing about it. Two days before the incident, his wife left his home and went to the house of the deceased. The overall facts of the case reveals that the incident happened in the fit of anger. The weapons allegedly used in the crime have been recovered. In these peculiar facts of the case, it would be inappropriate to keep the applicant behind bar. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Amit Narayan Khare, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with

938-ba-419-2023.odt (2) one solvent surety in the like amount in connection with Crime No.73 of 2023, registered with Ramanand-Nagar Police Station, District Jalgaon for the offence punishable under Section 302 of the Indian Penal Code, on the condition that he shall not tamper with the prosecution witnesses.
