Shri Upadhye, learned Advocate for the petitioner, submits that by order of this Court dated 12.06.1998, this petition after being admitted, was to be heard along with Writ Petition No. 5475 of 1996, which was filed by the respondent - establishment challenging the entire award dated 28.06.1996 delivered by the Labour Court, partly allowing Reference (IDA) No. 138/1992.

(2) W.P. No. 02223 of 1998 02.

He further submits that the employee has filed this petition only to the extent of denial of back wages by the Labour Court.

He further submits that the Writ Petition No. 5475 of 1996 was allowed by this Court by judgment dated 16.11.2009 and the entire impugned award has been set aside.

Considering the above, this petition is rendered infructuous and, therefore, stands disposed of. Rule is discharged.
