IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD BAIL APPLICATION NO.417 OF 2023 SHAIKH AJAZ SHIAKH IBRAHIM

VERSUS

THE STATE OF MAHARASHTRA ...

Advocate for Applicant : Mr. S. B. Solanke APP for Respondent: Mr. K. S. Patil .....

CORAM : S. G. MEHARE, J.

DATE : 15.03.2023 PER COURT :

1.

Heard the learned counsel for the applicants and the learned A.P.P. for the respondents/State.

2.

The applicant was released on bail. However, after releasing on bail, he did not attend the trial. Hence, he was arrested and his bail was cancelled. The learned Additional Sessions Judge, Aurangabad declined to release him again.

3.

The learned counsel for the applicant would submit that the charges have been framed. All accused are regularly attending the trial.

945-BA-417-23.odt 4.

The reasons quoted by the applicant for his absence were not justifiable. The applicant was represented by a lawyer. He also did not take the care of his client. Be that as it may, the trial is likely to be opened in near future. In the facts and circumstances this appears a fit case to direct the learned Additional Sessions Judge to expedite the trial. Hence, the order :-

ORDER

(I) The application stands dismissed.

(ii) The learned Additional Sessions Judge, Court No.7, Aurangabad is directed to expedite the trial and complete the same within nine months from the date of receipt of this order, subject to the co-operation of all the accused.
